Warranty

Durrett Interests provides a written new home warranty as a benefit to our buyers and clients. Our warranty is administered by American Construction & Education Services, Inc., dba ACES Builders’ Warranty. ACES Builders’ Warranty was created to provide performance standards for new homes, define the terms of a builder’s warranty obligations to the home buyer or client, establish a fair dispute resolution system and to inform home buyers or clients of their rights under Texas law. The warranty document also assigns responsibility for certain maintenance items of the home. The ACES Builders’ Warranty is purchased by the builder and provided to the buyer or client at closing. The builder agrees to build to code, regardless of whether the jurisdiction where the home is built requires such, engage independent code certified inspectors during construction, is encouraged to maintain general liability insurance and agrees to settle any disputes in the ACES Builders’ Warranty defined dispute resolution system.

The ACES Builders’ Warranty provides clearly written information on the builder’s responsibilities during the first year of the warranty, first and second year on certain mechanical systems and a full 10 years on major structural integrity of the home. It is fully compliant with state standards and is an approved warranty company by the Texas Residential Construction Commission. ACES, Inc. maintains the performance standards to incorporate current building products and standards and ensures the warranty is in compliance with Texas law. ACES legal counsel reviews it after each session of the Texas legislature for legal correctness. ACES acts as a third party in any dispute and provides competent experts to assist in resolving disputes quickly without costly court action. Both parties to the sale and purchase of the new home agree to participate in the dispute resolution system when signing the contract for the home.
